Terms of Service

Welcome to discover.fm. These Terms of Service (“Terms”) are a binding agreement between you and discover.fm (“we,” “us,” or “our”). They govern your access to and use of our website, apps, and related products and services (collectively, the “Service”).
By creating an account, browsing, listening, publishing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you accept these Terms on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” refers to that entity.
Who may use the Service
You must be at least 16 years old to use discover.fm. If you are under the age required to form a binding contract where you live, you may use the Service only with permission from a parent or guardian who accepts these Terms on your behalf.
You are responsible for ensuring that your use of the Service complies with applicable laws in your location.
Accounts and security
Some features require an account. When you register, you agree to provide accurate, current information and to keep it updated.
You are responsible for activity that occurs under your account and for safeguarding your credentials. Notify us promptly if you suspect unauthorized access.
We may refuse, reclaim, or change account names that impersonate others, infringe rights, or violate these Terms.
You may not transfer your account to another person without our written consent.
Listeners and curators
discover.fm connects people who publish music curation (“curators,” or “publishers”) with people who follow or subscribe to that curation (“listeners” or “readers”). Depending on how you use the Service, you may act in one or both roles.
Curators choose what to publish, including playlists, notes, and links to third-party listening services. Listeners may follow curators, save content, and receive updates. Features available in each role may change over time.
If you are a curator, we may provide subscriber information (such as email address, display name, and general location) through curator tools, including CSV export. You may use that information only to operate your discover.fm presence and communicate with subscribers about your publications. You may not sell, rent, or share subscriber lists for unrelated marketing, and you must honor unsubscribe requests and applicable anti-spam laws.
We do not guarantee reach, revenue, or placement for any curator. Editorial and discovery surfaces may highlight content at our discretion.
Your content
You retain ownership of original content you submit to the Service, including text, images, playlist descriptions, and other materials you upload or compose (“Your Content”).
Your Content must not violate law or third-party rights. Do not post material you do not have permission to use, including copyrighted recordings, artwork, or trademarks, except as allowed by law or license.
You are solely responsible for Your Content and for obtaining any licenses needed to share it.
- Do not upload malware or attempt to disrupt the Service.
- Do not harass, threaten, or discriminate against others.
- Do not publish spam, deceptive promotions, or misleading metadata.
- Do not scrape, bulk-harvest, or reverse engineer the Service except as permitted by law.
License you grant us
To operate discover.fm, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, and distribute Your Content as needed to provide and improve the Service. This includes formatting changes for different devices, generating previews, and showing Your Content to users you authorize (for example, subscribers or followers).
If you make content available to the public on the Service, you grant other users the limited right to access and interact with it through Service features, such as playback links, sharing, and following.
This license is for operating the Service only. It does not transfer ownership of Your Content to us. You may remove much of Your Content by deleting it or closing your account, subject to reasonable backup, legal, and safety retention described in our Privacy Policy.
Acceptable use
You may not use the Service in any manner that violates law, these Terms, or the rights of others. We may remove content and suspend or terminate accounts that we reasonably believe violate these rules.
Without limiting the foregoing, you agree not to:
- Circumvent access controls or probe systems without authorization.
- Use automated means to access the Service in a way that imposes an unreasonable load on our infrastructure.
- Collect personal information about other users without their consent, except where the Service expressly provides subscriber or audience tools to curators as described in these Terms.
- Misrepresent your identity or affiliation.
- Use the Service to distribute unlawful or infringing material.
Third-party services and links
The Service may link to or integrate with third-party platforms, including streaming providers. Those services are governed by their own terms and privacy practices. We do not control and are not responsible for third-party sites, apps, or content.
When you follow a link to listen on an external platform, your relationship is with that provider. Any purchase, subscription, or dispute with a third party is solely between you and that party.
YouTube API Services
discover.fm uses YouTube API Services to help match tracks and to create or update playlists on YouTube and YouTube Music when you import or update playlists from other streaming services.
By using discover.fm, you agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.
Information we access through YouTube API Services is also handled in accordance with the Google Privacy Policy, available at https://policies.google.com/privacy. See our Privacy Policy for details on the YouTube data we access and how we use it.
Content from others
Material published by curators and other users is their responsibility. We do not endorse user content and may not review everything posted on the Service.
You access user content at your own risk. To the fullest extent permitted by law, we disclaim liability for errors, omissions, or harm arising from content you encounter on discover.fm.
Paid subscriptions and purchases
Some curators may offer paid subscriptions or other paid features. Prices, billing intervals, and benefits are set by the curator or by us as described at checkout.
Unless stated otherwise at purchase, fees are non-refundable except where required by law. We may change pricing for Service-level plans with reasonable notice.
Payment processing may be handled by third-party providers. You agree to their applicable terms when you complete a transaction.
Copyright and complaints
We respect intellectual property rights and expect users to do the same. If you believe content on the Service infringes your copyright, contact us at info@discover.fm with sufficient detail to identify the work, the material at issue, and your contact information.
We may remove or disable access to material alleged to be infringing and may terminate repeat infringers when appropriate.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content will be accurate, complete, or current.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER DISCOVER.FM NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Suspension and termination
You may stop using the Service at any time. You may delete your account where account settings are available.
We may suspend or terminate your access, with or without notice, if we reasonably believe you violated these Terms, created risk for others, or if we discontinue the Service or your region.
Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnity, and dispute terms.
Privacy
By using the Service, you also agree to how we handle personal information as described in our Privacy Policy.
Changes to the Service and these Terms
We may modify the Service and these Terms from time to time. If we make material changes, we will provide notice by posting an update on the Service, by email, or by other reasonable means.
Changes take effect when posted unless a later date is stated. Continued use after the effective date constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service.
General provisions
You agree to indemnify and hold harmless discover.fm and its affiliates from claims arising out of your use of the Service, Your Content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules, except where mandatory local law applies.
Except where prohibited, disputes arising from these Terms or the Service will be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject.
